Terms of Service - Branded BG

1. Acceptance of Terms

By accessing or using Branded BG ("the Service"), operated at brandedbg.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Branded BG provides an AI-powered virtual background generation service. Users upload their company logo, select a background scene, and receive a professionally branded virtual background with the logo placed using scene-aware AI technology.

3. Account Registration

To use the generation features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Pricing and Payment

The Service operates on a credit-based system. Credits are purchased through Stripe and are used to generate branded backgrounds. Prices are displayed on the Service and may change at any time. All prices are in US dollars.

Credits are non-transferable between accounts
Credits do not expire
Each generation consumes one credit

5. Refund Policy

We want you to be satisfied with your purchase. If you are unhappy with the Service for any reason, you may request a full refund. Refund requests are subject to a manual review to prevent abuse.

To request a refund, email us at info@brandedbg.com with your account email and the reason for your request. We aim to process refund requests within 5 business days.

6. Intellectual Property

Your Content

You retain all rights to the logos and brand assets you upload to the Service. By uploading content, you grant us a limited license to process your logo solely for the purpose of generating your branded background.

Generated Backgrounds

You receive a commercial license to use the generated branded backgrounds for personal and business purposes, including use on video conferencing platforms, presentations, and marketing materials. You may not resell generated backgrounds as a standalone product.

Our Content

The background scenes, website design, and underlying technology are owned by Branded BG. You may not copy, modify, or distribute our background scenes or any other proprietary content outside of the generated backgrounds you have purchased.

7. Acceptable Use

You agree not to use the Service to:

Upload content that infringes on the intellectual property rights of others
Upload illegal, harmful, or offensive content
Attempt to reverse-engineer, decompile, or circumvent any security measures of the Service
Use automated tools to scrape or access the Service beyond normal usage
Resell or redistribute the Service or generated content as a competing product

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. AI-Generated Content

Our Service uses AI technology (Google Gemini) to place logos onto background scenes. While we strive for high-quality results, AI-generated outputs may occasionally contain imperfections. If you are unsatisfied with a generation, you may request a refund of the credit used (see Refund Policy above).

10. Limitation of Liability

To the maximum extent permitted by law, Branded BG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (such as intellectual property, limitation of liability) will remain in effect.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
